The terms and conditions listed out below have been designed to provide information to you about ThomWindsor’s stand and policies governing the different aspects of business at ThomWindsor, thereby becoming an informal contract that connects you, the buyer, to ThomWindsor, the seller.

The term ‘We’ refers to ThomWindsor, a Swedish company thomwindsor. When you opt to use the ThomWindsor website and purchase product(s) from it you automatically agree to the terms and conditions laid out below. It is therefore very important that you go through the terms and conditions thoroughly and carefully before or when you use our website.

Message of Confirmation

Once we receive your product order our back-end system automatically generates an electronic invoice that is sent immediately to the e-mail id you have provided to confirm your purchase at our website.

• Please ensure that you provide us with the correct e-mail id while registering with us to ensure you get the confirmation message from us.
• Ensure that you save the confirmation e-mail that we send you.
• It serves as a proof of purchase.

Payments

We accepted payments through credit cards, debit cards, e-wallets, and also invoicing options. All our payments and banking-related transactions are handled by our payment partner PayPal. Please note that ThomWindsor does not, under any circumstances, store credit card numbers of its customers.

• If you are paying by credit card or debit card the initial conditions are applicable immediately on approval of the card transaction.
• ThomWindsor reserves the right to automatically cancel your order if no payment is received after your order has been submitted.

Use of Promotional Codes

You are entitled to use promotional codes that we occasionally provide while purchasing a ThomWindsor product directly on our website. Please ensure that you enter the promotional code during the checkout process for it to be valid. Any promotional code entered after the purchase is considered invalid and will therefore not be honored.

Relevant Taxes and Tax Details

We calculate and declare all taxes to you at the end of your order; the order cost along with taxes and additional fees if any are chargeable form the final cost of your order. ThomWindsor is required by law to always declare an accurate value of each of our shipments to customers.

Order Terms and Conditions

We do not accept orders made in another person’s name without his stated and prior consent. Such an order will be immediately reported to the authorities for appropriate action.

We reserve the right to change our pricing and also correct any incorrectly priced:

• Orders
• Final sales

If we find a price to be incorrect, we reserve the right to cancel the order and refund to the customer the amount paid in the best way possible. We reserve the right to undertake this at any given time.

• All customers have the right to return a product to us pursuant to the following terms and conditions.
• The product must be returned within 30 days from receipt of the order.
• The customer can exercise this right fully only by ensuring that the product and its original packaging is returned in the same condition in which they were received by the customer.
• Customers must contact us to obtain the correct and valid return address to which the product package can be returned should they exercise the right to return an order.
• Any cost involved in shipping of the returned product will be borne by the customer.
• Customers are required to contact us within 30 days should they receive a product package that has been damaged during transport and shipping from our end for detailed information about suitable compensation.

Terms of Warranty

We offer a 24-month (2 year) warranty period on our products. Our warranty covers defects on the watch itself, specifically:

• Watch movement
• Indexes
• Hands
• Dial

No other watch parts are covered by our warranty offer.

Should you want to get a replacement during the warranty period, please contact us directly by filling up the form on the Contact Us page of our website.

• Enter ‘reclaim of purchase’ in the subject line of the form.
• Provide us your:
• Name
• Address
• Order number
• Detailed description of issue

Fees and repair/replacement charges are applicable even during the warranty term for the following:

• Failure to mention the name of the retail store where the watch was bought and the purchase date or rewriting the information thereby making it confusing or illegible.
• Failure to submit the warranty card/paper along with the watch.
• Damage or defects caused by exposure to fire or water, or a natural disaster.
• Damage or defects caused by subjecting the watch to modification or repair that is cosmetic or is unjustified or not a necessity.
• Damage or defects, caused due to improper use of the product, like:
  • Knocks
  • Dents
  • Crushing
  • Broken Glass or crystal
• Damages, defects, and aesthetical changes occurring due to:
  • Regular wear and tear
  • Aging

These include minor scratches on the watch’s surface or case or crystal, alteration of color or damage to the wristband, peeling off of plating, etc.

We charge for battery replacement during the warranty period as well.

We reserve the right to replace the case, dial, crystal, watchband, and crystal or any other parts therein  with substitute pieces should the original pieces not be available at our end.

Our warranty offer entitles you to receive free replacement of the product pursuant to the conditions mentioned herein and within the specified term period only. It shall in no way restrict or limit any lawful rights that the customer may have.

Personal Information

We reserve the right to save some of your data for the purpose of fulfilment of your order when you shop with us. We treat all personal information and details of our customers as extremely confidential.

• All images of products on our website are representative visuals of the product and should be viewed only as such. They do not guarantee a 100% reflection of the product’s actual appearance and characteristics.

Delivery and Cancellation

We ship products to destinations across the globe. All our shipments are delivered in collaboration with the postal services of different countries and their corresponding transport and logistics partners.

The customer has the right to cancel an order and return the delivered goods by contacting our customer support team or, alternatively, using the Contact Us form on our website. This has to be done within 30 days of receipt of the goods. The goods have to be returned to us without being unpacked and in the same condition in which they were received. Any cost incurred or risk involved while shipping the product back to us is to be borne solely by the customer.

If a customer does not wish to receive a product from us because of inordinate delay in delivery, it is his responsibility to cancel the order. If the order has already been dispatched from our end the customer is required to take receipt of the order as cancellation is invalid until he has confirmed the cancellation to us through telephone or e-mail. We reserve the right to cancel a purchase for a product that we have discontinued; in such a situation the customer will be refunded his money and we will notify him of a replacement or provide information about similar products available with us.

Terms and Conditions Governing Complaints

It is the responsibility of you, as the customer, to carefully and thoroughly check your products when you receive your shipment. This is essential to ensure and verify that it is the product that you had ordered for and that the product has not been compromised or damaged in any way during shipment.

If your product is damaged during shipment, it is your responsibility to inform the carrier about the damage, regardless of whether the damage is immediately visible or hidden. It is also your responsibility to contact and inform us within 30 days should you receive a product that has been damaged during shipping or does not match the product that you had actually ordered with us.

You are required to lodge any complaints that you may see fit to with our customer support team. You can do this by filling up the form provided on our website’s Contact Us page. Please ensure that you provide us with the order number and also reason for complaint for us to be able to respond at the earliest with instructions about returning the product to us. It is important that you treat any defective products that you return to us as faultless. Please ensure that whatever be the cause or type of product return, the product packaging is sufficiently strong to prevent damage during shipping and transit. Should we receive a returned product that is actually fault-free and in good working condition we reserve the right to return the product back to the customer. In case of a faulty product we reserve the right to offer a product of the same model as replacement for the faulty product. In the event that the faulty product has been discontinued or is not in stock, we reserve the right to offer the customer a full refund of the amount paid.

Liability

Any responsibility we may have related to errors during or in delivery is limited solely to the conditions of sale prevalent at that point in time. We are in no way – either directly or indirectly – responsible for issues relating to but not limited to:

Force Majeure

We may upload user generated content, like content from Facebook or other social media, on our website. We do not at any point claim ownership of any rights for any such content. The said content could include:

We also do not claim or take any legal responsibility for any such user-generated content on our website. Title Retention

All properties on our website remain the sole property of ThomWindsor until the payment is fully made.

Any attempt at fraud or fraudulent activity on our website will be immediately reported to the concerned authorities. We retain the right to cancel a purchase in the event of even suspicion of such a fraud being perpetrated by a customer.

Governing Law and Jurisdiction

All the terms hereby laid down on this Terms and Conditions page are governed by the laws of Sweden. Swedish courts retain exclusive jurisdiction for any dispute from the use of our website by a customer being contrary to the terms laid down here, to the extent permissible by law. We also retain the right to prosecute a user of our website perpetrating fraud or any other such activity on our website directly at his or her place of residence.

Termination

We reserve the right, at any point of time, to terminate a customer’s account at our sole discretion. This right automatically extends to termination of your use of our website as well. We reserve the right to enforce such a termination without prior notice.
